Permanent Diversion of Part of Definitive Footpath MilFp330 in Milnrow pdf icon PDF 106 KB

    To consider the permanent diversion of part of definitive footpath MilFp330.

    The Township Committee considered a report seeking the diversion of footpath MiLF p330 in Milnrow, to ensure that the general public have continued use of a route when the houses are erected on land over which the footpath runs. 

     

    Alternatives considered:

    To refuse to make the order could be detrimental to the Council as it would be contrary to the authorised Planning Permission and could lead to the developer seeking compensation.

     

    Decision:

    (1)  The diversion of the identified section of footpath MilFp330 be approved;

    (2)  The Head of Legal Services be delegated authority to complete the process and update the definitive rights of way map.

    (3)  Should the Council receive any objections that cannot be resolved the matter be referred to the Secretary of State for a final decision.

     

    Reason for decision:

    The Council has a duty to protect the rights of the public to the use and enjoyment of any highway. The Council are required to maintain and keep under review the definitive map, and statement showing the public footpaths and bridleways in its area.

Objections to Traffic Regulation Order - West View / Ealees, Littleborough pdf icon PDF 1 MB

    To consider the introduction of a Traffic Regulation Order at West View / Ealees, Littleborough.

    Minutes:

    The Township Committee considered a report advising of objections to an advertised Traffic Regulation Order in relation to West View/Ealees in Littleborough and seeking approval of the proposed parking restrictions. 

     

    Alternatives considered:

    The objections suggested the restrictions will unnecessarily reduce the number of available on-street parking spaces for residents and visitors, have a detrimental effect on the look of the area and requested that a residents parking scheme was introduced instead. In light of this Members could be implemented as advertised, be amended, or be abandoned.

     

    Decision:

    That Traffic Regulation Order, Borough of Rochdale ((Civil Enforcement of Traffic Contraventions) (Various Streets) (Pennines Township) Order 2008) (Amendment) (No.63) Order be implemented as advertised.

     

    Reason for decision:

    To reduce the impact on the business at Ealees Mill caused by delays in the delivery of goods.

    To be advised on the latest position regarding the Council’s Revenue Budget for 2018/19 to 2020/21, and Savings Proposals in order to meet the budget gap for 2018/19 and 2019/20.

    The Township Committee considered a report detailing the latest position regarding the Council’s Revenue Budget for 2018/19 to 2020/21.

     

    Alternatives considered:

    The item was presented for information.

     

    Decision:

    The Revenue Budget position for 2018/19 to 2020/21 and the potential risks around the Revenue Budget be noted.

     

    Reason for decision:

    The Council is required to set a balanced budget for 2018/19 by the by 11th March 2018.

    To be advised on the proposed 2018/19 Capital Programme and provisional programmes for 2019/20 and 2020/21.

    Minutes:

    The Township Committee considered a report seeking views on the proposed Capital Programme 2018/19 – 2020/21.

     

    Alternatives considered:

    Consultation on the proposed Capital Programme is legally required.

     

    Decision:

    The Capital Programme and provisional programmes for 2019/20 and 2020/21, be noted.

     

    Reasons for decision:

    The Council is legally obliged to set a balanced budget.  Budgets are prepared in accordance with the approved guidelines.

Presentation - Compulsory Purchase Orders

    To introduce the notion of a rolling programme of compulsory purchase actions.

    Minutes:

    The Township Committee received a presentation detailing a new rolling programme of compulsory purchase actions involving largely high profile sites & buildings. The programme was anticipated to run for three years with one million pounds per annum included within the Capital Programme.

     

    Decision:

    That the presentation be noted.

Exclusion of Press and Public

    To consider that the press and public be excluded from the remaining part of the meeting pursuant to Section 100(A)4 of the Local Government Act 1972 on the grounds that discussions may involve the likely disclosure of exempt information as defined in the provisions of Part 1 of Schedule 12A to the Local Government Act 1972 and public interest would not be served in publishing the information.

    Decision:

    That the Press and Public be excluded from the meeting during consideration of the following three items of business, in accordance with the provisions of Section 100A (4) of the Local Government Act 1972, as amended.

     

    Reason for Decision:

    Should the press and public remain during debate on these items there may be a disclosure of information that is deemed to be exempt under Parts 1 and 4 of Schedule 12A of the Local Government Act 1972.

Compulsory Purchase Orders potential sites

    To seek Members suggestions for potential sites.

    Minutes:

    Members of the Township Committee were asked to identify sites that could be considered for CPO.

     

    Decision:

    That Members of the Township Committee be requested to nominate potential sites to be included within the Compulsory Purchase Order (CPO) programme via the Township Office.

     

    Reason for decision:

    There must be ‘justification’ for proceeding with a CPO, factors can include the number of complaints received by Members, loss of visual amenity, development requirements and gateway considerations.
