    In accordance with Council Procedure Rule 25.1, the Chair indicated that there was an additional item of business to be considered, namely an additional request for an allocation of Township Funds for Syke Community Base, the grounds of urgency being that the Sub-Committee were required to make a determination thereon prior to the next scheduled meeting of the Rochdale Township Action and Resources Committee.

    The Deputy Chief Executive presented a report which updated the Committee on revenue and capital expenditure, commitments and balances of Rochdale Township Fund 2014/2015, to enable the Committee to allocate funds to proposed projects.

     

    The recommendations contained in the report were presented as the management of the Rochdale Township Fund was a function delegated to this Committee to determine. Rochdale Township Funds were designed to be allocated to projects that benefit the Township’s communities and environment and which realise the Township’s stated priorities. The Committee monitors and reviews the use of the Rochdale Township Funds to ensure continued efficient and effective use of the Township’s Funds.

     

    The Committee considered applications for funding from the 2014/2015 Township Revenue and Capital Funds and the balances of £38,747 (Capital Fund) and £30,093 (Revenue Fund) were detailed in the submitted report.

     

    Alternatives considered: in considering the report, Members will decide whether or not to approve the allocation of funds to projects/schemes as appropriate.

     

    In relation to application TC/08/14 for Off Street Parking at Muriel Street/St Peter's School, Members were advised that there were insufficient funds available in the Capital Fund to fund the scheme outlined in appendix 5 to the submitted report in full.

     

    In relation to application RW/11/14 to assist with a projected shortfall in funding to March 2015 at Syke Community Base the Principal Townships Officer advised the Committee that the terms and conditions of the Township Funds do not permit funding of general running costs and that an allocation of funds for this purpose may set a precedent, and approval of this application would be contrary to Officer recommendation.

     

    DECIDED – That (1) the expenditure, commitments and balances for Rochdale Township Revenue and Capital Funds, as detailed in Appendices 1 and 2 of the submitted report be noted;

    (2) the decisions made under delegated authority as detailed at Appendix 3 of the submitted report be noted;

    (3) the summaries of evaluation information for projects funded as detailed in Appendix 4 be noted;

    (4) the Principal Townships Officer had assessed the proposed projects to be considered for funding against the criteria of the Rochdale Township Fund, priorities of the Township and that any specific risks had been identified as detailed in Appendix 5 of the submitted report be noted.

    (5) Principal Townships Officer, in consultation with the Chair, Vice Chair and opposition spokespersons of the Committee, be given delegated authority to make decisions on any deferred projects.

                (6) the proposed schemes as detailed in Appendix 5 of the submitted report be dealt with as follows:-

    a) TC/04/14 – the introduction of traffic calming measures with three round topped speed humps and extension of the existing 20mph zone to encompass Count Street, Rochdale approved at the meeting of the Rochdale Township Action and Resources Committee held on 1st July 2014 be withdrawn and the allocation of £21,250 be de-committed and returned to the Rochdale Township capital fund;

Section 38 (Highways Act) Agreement :- Norman Road pdf icon PDF 96 KB

    The Committee considered the report of the Director of Economy and Environment which sought approval to dissolve the Section 38 (Highways Act) Agreement between Rochdale Borough Council and Robert Riley Limited (the Company) in respect of land at Norman Road, Rochdale.

     

    The recommendations in the report were brought forward as Robert Riley Limited entered into a Section 38 Agreement with the Council on the 28th August 1990 to construct a road, footpaths, street lighting facilities and service strip (the Works) so that they should become highways maintainable at the public expense. The Company requested that the Council, upon being satisfied on completion of the Works and after the period of maintenance, would agree to take over the Works as highways maintainable at public expense.              Since completion, the Works have not been adopted by the Council as highways maintainable at the public expense because the Company had failed to observe and perform the covenants and conditions of the Agreement and because the Company subsequently went into liquidation. 

     

    Alternatives considered - The alternative to this proposal is to continue with the agreement in place in perpetuity, however, the Agreement as it stands cannot be performed.

     

    DECIDED – that (1) the Section 38 (Highways Act) Agreement entered into on the 28th of August 1990 between Rochdale Borough Council and Robert Riley Limited (the Company) in respect of land at Norman Road, Rochdale be dissolved in respect of Clause 8 of the Agreement.

    (2) That the Deputy Chief Executive be authorised to issue a notice to determine the Agreement in accordance with the provisions of the Agreement.
