    Members are reminded that, in accordance with the Localism Act 2011 and the Council's adopted Code of Conduct, they must declare the nature of any discloseable pecuniary interest; personal interest and/or prejudicial interest required of them and, in the case of any discloseable pecuniary interest or prejudicial interest, withdraw from the meeting during consideration of the item, unless permitted otherwise within the Code of Conduct.

    Minutes:

    The Committee considered the report of the Director of Neighbourhoods which updated Members as to the events and activities undertaken in addition to purchasing books to engage people with the Maskew Collection.

     

    The Committee received a presentation on the engagement activities undertaken since April 2015 including the Rochdale Literature and Ideas Festival held on 23rd – 25th October 2015. The Committee were advised of the expenditure from the Maskew Bequest for the Festival of £26,400 which represented a considerable saving on the costs in previous years due to a large increase over previous years in sponsorship of the event and ticket sales.

     

    The future plans for the Maskew Bequest were outlined which would maintain the collection for over 50 years and would continue to include engagement activities, including the Literature and Ideas Festival at its current level,  if suitable amounts of sponsorship could be obtained.

     

    DECIDED – that the report and presentation be noted.

    The Committee considered a report of the Head of Legal Governance and Reform which advised Members of the advice of the Independent Advisor to the Committee,

    Mr Mark Halliwell, Barrister at Law with regard to the nature of the bequest made by Doctor Chadwick.

     

    The Charitable Trustee Committee, at its meeting held on 10th August 2015, had authorised the Head of Legal and Governance Reform to commission independent legal advice in relation to the respective ownerships of the various plots of land held under the terms of the will of the late John Chadwick dated 9th September 1922 and his codicil dated 19th September 1925  together with the terms of the conveyance of his residuary estate made between George Geoffrey Collins, the Executor and Trustee of the will and Milnrow Urban District Council  dated 4th September 1956

     

    The Committee was advised that in Counsel’s opinion the gift in the Will of Doctor John Chadwick was not a gift which should be the subject of charitable trusts because his wishes included non-charitable objects. In Counsel’s opinion, the assets were wrongly registered with the Charity Commission in the year 2000 and that he had advised the Council to apply to the Charity Commission for an order removing Doctor Chadwick’s Trust Fund from the register of charities.

     

    DECIDED – that the Head of Legal Governance and Reform be authorised to make an application to the Charity Commission under Section 34 of the Charities Act 2011 for an order removing the Doctor Chadwick’s Trust Fund from the register of charities.
