Erection of a 45m high wind turbine with associated infrastructure

    Minutes:

    The Director of Economy and Environment reported on submitted planning application 15/00212/FUL for the erection of a 45m high wind turbine with associated infrastructure, at Birch Industrial Estate, Whittle Lane, Heywood.

     

    There were no objectors present and the applicant and their agent addressed the Committee.

     

    DECIDED - that planning permission be granted subject to the conditions detailed within the submitted report.

Change of use of ground floor office space to wine bar

    Minutes:

    The Director of Economy and environment reported on submitted planning application 15/00147/FUL, a resubmission of 14/01227/FUL, for the change of use of ground floor to a wine bar at 1 Shaw Road, Newhey, Milnrow.

     

    There were no objectors present and the applicant addressed the Committee.

     

    Councillor Butterworth spoke as Ward Councillor.

     

    DECIDED - that planning permission be granted subject to the following conditions:-

     

    1      The development must be begun not later than the expiration of three years beginning with the date of this permission.     

                           

             Reason: To comply with the requirements of section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

     

    2      This permission relates to the following plans:-         

                -           Location Plan - Received 9th February 2015

                -           General Arrangement - Drawing no. EPS1000_GA Rev B –                   Received 9th February 2015

                -           Planning Statement - Received 9th February 2015  

            and the development shall be carried out in complete accordance with these drawings hereby approved.           

               

            Reason: For the avoidance of doubt and to ensure a satisfactory standard of development in accordance with the policies contained within the adopted Rochdale Unitary Development Plan and the National Planning Policy Framework.

     

    3      Prior to the use hereby approved first commencing on site, a Management Plan detailing the measures to be put in place to protect nearby residents from unacceptable noise levels shall be submitted to and approved in writing by the Local Planning Authority.  The measures detailed in the Management Plan shall be implemented in full upon first commencement of the use and the use shall be operated in accordance with the agreed Management Plan at all times when the premises are in use.    

                           

             Reason: In the interest of residential amenity and to accord with policies G/EM/1, EM/2 and EM/3 of the Rochdale Unitary Development Plan.

     

    4      The use hereby approved shall not be operated outside the hours of 12:00 - 23:00 Sunday to Thursday and 12:00 to 24:00 on Fridays and Saturdays.     

                           

                Reason: In the interest of residential amenity and to accord with policies G/EM/1, EM/2 and EM/3 of the Rochdale Unitary Development Plan.

     

    5         No amplified sound shall be played or operated from the premises.

                           

                Reason: In order to safeguard the amenities of the area and to prevent nuisance arising in accordance with Policies EM/1, EM/2 and EM/3 of the Council’s adopted Unitary Development Plan.

     

    6         The external access door sited on the elevation facing Huddersfield Road and adjacent to no. 2 Huddersfield Road shall be used for emergency purposes only.   

                           

                Reason: In the interests of residential amenity and to reduce undue disturbances to nearby residential properties and to accord with policies G/EM/1, EM/2 and EM/3 of the Rochdale Unitary Development Plan.
