Residential development for the erection of 43 dwellings and associated works at land bound by Cherwell Avenue/Bank Top Street/George Street, Heywood, OL10 4SE

    Minutes:

    The Director of Economy and Environment reported on submitted planning application 14/01420/FUL, a residential development for the erection of 43 dwellings and associated works at land bound by Cherwell Avenue/Bank Top Street/George Street, Heywood, OL10 4SE.

     

    The Director of Economy and Environment informed the Committee that the route diversion for the Highways crossing the site would need to be undertaken under Section 257 of the Town and Country Planning Act 1990 (rather than section 247 of the Act). The recommendations had been amended accordingly so that in the event of an application under section 257 Town and Country Planning Act 1990 (as amended) related to the granting of the permission, that Members authorise relevant officers to make the appropriate order and confirm the same in the event of an unopposed order; or in the event of an opposed order to facilitate so far as the Head of Planning shall deem to be appropriate the conclusion of such an application.

     

    The Director of Economy and Environment updated the Committee in relation to an additional consultation response from United Utilities, who had no objections subject to a condition ensuring that the flow control system within the drainage scheme restricted the surface water flow rate into the combined sewer to a maximum of 6 litres per second. 

     

    Members of the Committee were informed that seven additional responses had been received from neighbouring residents raising objections to the proposed development including -

     

    • Loss of valued and well used community asset and open space.
    • There is no need for the proposed housing.
    • There are other ugly and derelict brownfield sites that need building on and regenerating.
    • Inadequate public consultation has taken place.
    • Heywood is already subject to traffic congestion and the proposals would generate additional vehicular traffic congestion on the surrounding roads.
    • The surrounding area has been subject of flooding in the past and the proposed development would prevent the natural drainage of rainwater through the site.

     

    The Committee considered the views of Mr Sandiford, a local resident who addressed the Committee objecting to the planning application.

     

    The Committee considered the representations made by Mr Hughes of Countryside properties, the agent for the applicant. 

     

    The Committee considered the views of a Councillors O’Rourke and McCarthy, who address the Committee in support of the objectors.

     

    DECIDED – That (1) planning permission be approved subject to conditions as detailed within the submitted report;

                (2) in the event of an application under section 257 Town and Country Planning Act 1990 (as amended) related to the grant of the permission, that Members authorise relevant officers to make the appropriate order and confirm the same in the event of an unopposed order; or in the event of an opposed order to facilitate so far as the Head of Planning shall deem to be appropriate the conclusion of such an application.
