Neighbourhood Planning – Designation of the proposed Thornham St. John's Neighbourhood Area and Forum pdf icon PDF 1 MB

    To seek Township approval to designate the Thornham St. John's Neighbourhood Area and Forum

    Minutes:

    The Township Committee considered a report of the Director of Economy that informed Members that consultation has taken place on the applications for the designation of a Neighbourhood Area and a Neighbourhood Forum for Thornham St. John's. The report sought approval to designate the Thornham St. John's Neighbourhood Area and Forum to support future preparation of the Thornham St. John's Neighbourhood Plan.

     

    The Committee was advised that the report was also due to be considered by Middleton Township Committee at its next Meeting on 13th June 2019.

     

    Alternatives considered:

    The Neighbourhood Planning (General) (Amendment) Regulations 2015 prescribed time limits for the determination of neighbourhood area applications. Except where a local planning authority is required to designate the whole of a parish, applications must be determined within 13 weeks of first being publicised, or 20 weeks where the application relates to more than one local planning authority area. If these time limits are not met, the local planning authority must designate all of the area applied for.

     

    Resolved:

    1.     That Rochdale South Township Committee approves the Thornham St. John's Neighbourhood Area and Forum for designation.

    2.     That, subject to approval by Middleton Township Committee, on 13th June 2019, the area and forum designation should be publicised on the Council’s website as soon as possible.

     

    Reasons for the Decision:

    The Neighbourhood Planning (General) Regulations 2012 required that provided the Thornham St. John’s Neighbourhood Area and Forum applications meet the requirements as set out in Sections 61F to 61L of the Town and Country Planning Act 1990 and Parts 2 and 3 of the Regulations, then the Council must publicise the applications for 6 weeks.

     

    These Regulations require that the Neighbourhood Area and Neighbourhood Forum must, inter alia: have a constitution; at least 21 members representative of the area and no part of the proposed Neighbourhood Area may overlap with any other designated Neighbourhood Area.

     

    It is considered that the Thornham St. John’s Neighbourhood Area and Forum applications satisfies the requirements of the Regulations, and as no objections were received, the recommendation is to designate Thornham St. John’s as a Neighbourhood Area and Forum.

     

    The application of a neighbourhood Area and Forum will enable the community to begin the preparation of a Neighbourhood Plan for their area.

    To approve Rochdale South’s Township Funds terms and conditions, and to agree delegation arrangements concerning funding decisions.

    The Committee considered a report of the Director of Neighbourhoods that asked Members to approve the Rochdale South Township Funds’ terms and conditions, and to agree delegation arrangements concerning funding decisions.

     

    Alternatives considered:

    In considering the report, the Committee’s Members were asked to decide whether or not to approve the allocation of funds to funding streams and to adopt appropriate terms and conditions.

     

    Resolved:

    1.     The Committee notes the expenditure, commitments and balances for Rochdale South Township revenue and capital funds at financial year end 2018/19 (as outlined at Appendix 1 and 2 of the submitted report).

    2.     The Committee notes the findings of the review of Township Funds 2018/19 (as outlined at Appendix 3 of the submitted report) and evaluations received to date for some of the projects funded (as outlined at Appendix 4 of the submitted report).

    3.     The Committee approves the allocation of Rochdale South Township Funds to funding streams in 2019/20 as detailed in Appendix 5 of the submitted report, subject to an amendment, approved by the Committee, that the Ward Fund will be £30,000 and not £20,000 as stated in the report.

    4.     The Committee approves the terms and conditions for Rochdale South Township’s revenue and capital funds for 2019/20 (as described at Appendix 6 of the submitted report).

    5.     The Committee authorises the delegation arrangements for Rochdale South Township Funds 2019/20 as detailed at 4.6 of the submitted report.

    6.     The Committee authorises any uncommitted/unspent funds be reallocated to a central revenue or capital funding stream as appropriate before the end of January 2020 to enable Members to spend/commit all Rochdale Township Funds during 2019/20 financial year.

     

    Reasons for the decision:

    The management of the Rochdale South Township Fund is a matter that is delegated to the Rochdale South Township Action and Resources Delegated Sub Committee to determine. Rochdale South Township Funds are allocated to projects that benefit the Township’s community and environment, and realise the Township priorities. The decision enables the Committee to monitor and review the use of the Rochdale South Township Funds to ensure continued efficient and effective use of those funds.

Rochdale South Township Delegation Arrangements and Appointments 2019/20 pdf icon PDF 98 KB

    The Committee is requested to confirm its delegated decision making arrangements and to make appointments to the Township Sub-Committees and other bodies.

    The Township Committee considered a report of the Director of Resources that requested that Members confirm their delegated decision making arrangements and make appointments to the Township Sub-Committees, including the Chairs, Vice Chairs and substitute members; the appointment of “lead” opposition spokespersons; and the appointment to other bodies.

     

    Alternatives considered:

    The Committee could choose not to appoint Sub-Committees and undertake all delegated functions themselves, however this could have a detrimental impact on the ability to progress Township priorities or to deal with urgent items of business. The Committee could also, if it chose to do so, adopt alternative Sub-Committee arrangements.

     

    Resolved:

    1.    The proposed Sub-Committee structure of the Rochdale South Township Committee comprising of the Rochdale South Township Action and Resources Delegated Sub-Committee and the terms of reference, as outlined at Appendix 1 of the submitted report, be approved;

    2.    Members be appointed as follows: –

    (a)          Rochdale South Township Action and Resources Sub-Committee:

    Councillors – Mohammed Zaman (Chair), Wraighte (Vice Chair), Shakil Ahmed, Hornby, Meredith, Nickson, Rashid, Angela Smith, Sullivan and Zaheer.

    Substitute Members - Councillors Daalat Ali, Brett, Farnell, Howard and Sheerin;

    The opposition spokesperson be Councillor Sullivan;

    (b)          The relevant Ward Councillors be appointed to attend their respective Ward Forum;

    (c)          Rochdale Regeneration Group – All Members of the Rochdale South Township Committee to be invited to attend meetings

    (d)       Township Older Persons Champion – Councillor Zaman;

    (g)       Township Young Persons Champion – Councillor Meredith;

    (h)       Rochdale South Township Planning Panel – All members of the Rochdale South Township Committee to be invited to attend meetings - except those Members who have also been appointed to the Council’s Planning and Licensing Committee

    (3) Any amendments to the appointments be delegated to the Chair of the Rochdale South Township Committee to determine.

     

    Reasons for the decision:

    The Council has established and appoints Township Committees that may exercise both executive and non-executive powers as set out in the Responsibility for Council Functions in Part 3 of the Constitution, which states that: appointments to Township Sub-Committees, Township Working Parties, Partnership Arrangements and Local Outside Bodies shall be made at the first meeting of the appropriate Township Committee in the new Municipal Year’.

     

    The Sub-Committee exercises either delegated powers or acts on any matter detailed in the Committee’s Terms of Reference on which it is essential to take a decision.
