Purpose:

to provide update on SEN school project funded by DfE under the SEN/AP Wave 2 and seek approval for expenditure on building abnormals.

Decisions:

Cabinet considered the report of the Director of Children’s Services which advised that in 2019 Rochdale was awarded one of the new central government SEN schools. As part of this process the Department for Education, DfE, required the Children’s Services to abide by cost stipulations with regards to delivery of the new school.

 

To continue further with delivery of the school the DfE now require approval from Rochdale Council for expenditure related to the costs and the approval for provision of an associated S151 letter to formalise the payment agreement.

 

Alternatives Considered:

 

The only alternative to the new SEN school funded by the DfE, is a Council funded new school or increased expenditure on out of borough provision. 

 

Resolved:

 

1.    That the expenditure from schools capital Basic Need funding as detailed within the report to forward fund the DfE for building works associated with s278 and abnormals at the site of the new Rochdale Academy SEN school in Heywood be approved;

 

2.    That the expenditure of expected receipts of secondary education s106 contributions that are in agreed legal agreements from the Langley Masterplan developments to refund forward spend of the Basic Need spend as detailed within the report be approved;

 

3.    That the expenditure of expected receipts of secondary education s106 contributions that are part of the Junction 19 development, which are due to be paid over the life cycle of the development to refund forward spend of the Basic Need spend as detailed within the report be approved;

 

4.    That the provision of a section 151 letter from the Council to the Department for Education to cover the expenditure as detailed within the report be approved.

 

5.    That Basic Need schools funding for a full time temporary legal administrator position for 12 months to cover legal works related to this new school and the other DfE funded new schools under development in the borough be approved.

 

Reasons for the Decision:
