To consider the Authority’s Statement of Licensing Policy 2021 – 2026 and to make appropriate recommendations to Full Council thereon.

The Committee considered a report of the Director of Neighbourhoods that sought approval of the authority’s Statement of Licensing Policy 2021-2026. The Council was required to determine and publish a Statement of Licensing Policy every five years in order to meets its statutory obligations. The determination and publishing of such was required to be undertaken by January 2021.

 

The purpose of the policy statement was to define how the Council’s responsibilities under the Licensing Act 2003 were going to be exercised and administered.

 

Under the terms of the Act the Council was required to consult with the public on any proposed changes to the Policy. The report outlined that one consultation response had been received on the Council’s draft Statement of Licensing Policy, which had been duly considered, and sought agreement from members on amendments where necessary and to recommend adoption of the policy to full Council.

 

Resolved:

1.     The Committee notes the response received on the consultation exercise.

2.     The Committee endorses the proposed changes to the Authority’s Statement of Licensing Policy 2021-2026.

1.     The Committee approves the amended Statement of Licensing Policy 2021-2026 and recommend that the policy be approved and formally adopted by the Cabinet and Council.

Change of use from financial and professional services (A2) to nightclub (Sui Generis).

The Head of Planning presented planning application 20/00805/FUL, for a change of use of premises from financial and professional services (A2) to a nightclub (Sui Generis) at 5 Market Place, Middleton.

 

The Committee received representations from Mr. E. Ndenguma, the applicant, who addressed Members in support of the application.

 

The Committee were addressed by Councillors Nolan and Donna Williams, North Middleton Ward Members, in whose Ward the proposed development was located.

 

Resolved:

That planning permission be refused due to the possibility of anti-social behaviour occurring in and around the vicinity of the application site, if planning permission was to be granted. Anti-social behaviour was considered by the Committee to be a material fact which would have a negative impact on the conservation area where the site under consideration is located.

Site visits

It has been agreed with the Chair of the Planning and Licensing Committee that, in view of the current COVID-19 guidance specific to Rochdale, there will be no site visits for the agenda items.

 

Members are free to view the application sites from public vantage points without entering private property, and are encouraged to make use of Google Earth and Google Streetview prior to the meeting.
